Full Renovo Terms of Service
These Terms define the rules and conditions for providing digital services via www.renovophoto.cloud.
§ 1. Introductory Provisions
- 1. These Terms (the "Terms") govern the provision of digital services via the Renovo website available at https://www.renovophoto.cloud (the "Service").
- 2. The Service owners and providers are Maciej Fiłonowicz (58-100 Świdnica, Poland) and Krystian Flisak (58-100 Świdnica, Poland) acting jointly (the "Providers").
- 3. Contact the Providers at prospectcode@gmail.com.
- 4. Every person using the Service (the "User") must read and accept these Terms and the Privacy Policy before starting the Service.
§ 2. Definitions
- Service: The website located at https://www.renovophoto.cloud.
- Providers: Maciej Fiłonowicz and Krystian Flisak.
- User: A natural person with full legal capacity who uses the Service.
- Service (capitalised): A single provision consisting of automated processing (restoration) of a Photo using AI and delivering the processed file for download.
- Photo: A digital file uploaded by the User (Original Photo) or generated by the Service (Processed Photo).
- Agreement: A distance contract for the provision of the Service (digital content) concluded when the User completes the payment.
- Price List: The current price visible in the Service when placing an order.
§ 3. Technical Requirements
- To use the Service the User needs:
- 1. A device with Internet access.
- 2. An up-to-date web browser.
- 3. An active email account (to receive the download link).
- 4. Enabled Cookies and JavaScript.
§ 4. Service Use and User Content
- 1. The User must use the Service lawfully, ethically and in line with these Terms.
- 2. By accepting the Terms the User declares that they hold all rights, including copyrights and third-party consents (especially image rights) necessary to legally upload the Photo and request its modification.
- 3. It is strictly forbidden to upload Photos containing: a) Illegal content, hate speech, promotion of violence or discrimination. b) Material infringing copyrights, trademarks, patents or personal rights. c) Nudity or pornographic content, especially depictions of child sexual abuse (CSAM).
- 4. The Providers reserve the right to report any suspicion of content described in point 3(c) to law enforcement without delay.
- 5. Any attempts to destabilise the Service, reverse engineer, scrape, bypass security or overload the infrastructure are prohibited.
- 6. The Providers may block access or refuse the Service if the User grossly violates this paragraph.
§ 5. Contract Formation and Delivery
- 1. The Agreement is concluded once the User successfully pays via the payment operator (Stripe).
- 2. The process consists of: a) Uploading the Original Photo. b) Reading and accepting these Terms and the Privacy Policy (checkbox). c) Providing the required declarations and consents (including the waiver of the withdrawal right). d) Making the payment according to the Price List.
- 3. The Service (AI processing) starts immediately after the payment is booked.
- 4. After processing, the User receives (e.g. on the website or via email) a unique link to download the Processed Photo.
- 5. The download link stays active for 30 days. After that both the Original and Processed Photos are permanently deleted. The Providers are not obliged to archive or restore deleted files.
§ 6. Payments
- 1. The Service is paid as per the Price List valid when placing the order.
- 2. We only perform the Service after receiving the upfront payment.
- 3. Payments are handled by Stripe, Inc. The Providers do not process or store card data.
- 4. By paying, the User accepts Stripe's terms.
- 5. The User agrees to receive invoices or confirmations electronically (if applicable).
§ 7. Provider Liability
- 1. The Providers deliver the Service in an automated manner. It is supplied "as is" and "as available".
- 2. The Providers DO NOT GUARANTEE that the aesthetic result will meet the User's subjective expectations. AI algorithms work autonomously, may differ from expectations and may include artefacts. Dissatisfaction with the look is not grounds for a complaint.
- 3. The Providers are not liable for downtime or data loss caused by: a) Force majeure. b) Failures of third-party providers (OVH, Google, Stripe, ISPs). c) User errors. d) Acts of third parties (e.g. hacking).
- 4. The Providers are not responsible if the User fails to download the Processed Photo within 30 days.
- 5. To the maximum extent permitted by law, the Providers' total liability is limited to the fee actually paid for the single Service concerned.
- 6. The Providers exclude liability for lost profits.
§ 8. User Liability (Indemnity)
- 1. The User bears full responsibility for the content of Photos and for holding all rights and consents needed for lawful processing by the Service (see § 4(2)).
- 2. Indemnity clause: If any third party raises claims against the Providers (Maciej Fiłonowicz or Krystian Flisak) due to the User's infringement (especially IP or image rights) related to the Photo, the User agrees to: a) Fully indemnify the Providers against that claim. b) Cover all justified costs incurred to defend the claim, including legal fees, court charges, fines or damages awarded or settled.
§ 9. Complaints
- 1. The User may file complaints only about technical aspects of the Service or non-compliance with the Agreement (e.g. payment error, inability to download).
- 2. Complaints cannot be based on subjective dissatisfaction with the aesthetic result (§ 7(2)).
- 3. Send complaints via email to prospectcode@gmail.com.
- 4. The complaint must include: a) The User's email (if provided) or transaction ID. b) The date the Service was rendered. c) A precise description of the technical issue.
- 5. The Providers respond within 14 days of receiving the complaint.
§ 10. Right of Withdrawal
- 1. Under Art. 38(13) of the Polish Consumer Rights Act, consumers cannot withdraw from a contract for digital content not supplied on a tangible medium once performance starts with their explicit consent before the withdrawal period ends.
- 2. By accepting these Terms and requesting immediate performance (processing the Photo) through payment, the User gives explicit consent to start before the 14-day withdrawal period expires.
- 3. The User acknowledges and confirms that they lose the statutory withdrawal right once the Service begins.
§ 11. Final Provisions
- 1. Matters not covered here are governed by Polish law.
- 2. The Providers may amend these Terms. Changes take effect upon publication on the Service and apply to Agreements concluded afterwards.
- 3. Disputes will be resolved by the common court competent for the Providers' residence (Świdnica, Poland), except that consumer Users may rely on general jurisdiction rules.
